If you are a consumer (i.e. if you are not buying, in whole or in part, for purposes related to trade, business, craft or professional activities), pursuant to Article 52 of the Italian Consumer Code, you have the right, in addition to the other rights awarded to you, to terminate this Contract without just cause and to receive a refund of the price paid (except in the cases provided for in Article 59 of the Italian Consumer Code, for example for the purchase of customised or engraved products, unless those products were already damaged or defective at the time of delivery or were delivered incorrectly).
You may cancel the Contract at any time before the Product is delivered and up to 14 days after that date, with effect from the purchase date of your Order (the “Cooling Off Period”).
To exercise the right of cancellation, you must fill in the cancellation form available on our Website and send it within the above time limit.
If you decide to cancel the Contract, you must return the Product(s) at your own cost and risk to our address (Via Bogino 8, 10123 Turin, Italy). We advise you to make sure that the Product(s) is (are) adequately insured for the transport.
The Products must be returned within 14 days from the date of notification of the cancellation, in the same condition they were received in, including the packaging. If you do not return the Product(s) within 14 days from the cancellation or at our request (if earlier), we can collect the Product(s) from you, at your expense.
You must take due care of the Jona Product(s) in your possession. If you fail to do so, we reserve the right to deduct the cost of any deterioration of the Product(s), up to the total price, from the amount that you would otherwise be entitled to as a refund.
The recipients of gifts are entitled to the replacement of non-refundable goods or may request that the refund be made to the buyer of the Product(s). To replace the gift chosen by you or to request a refund credited to the buyer, please contact us by telephone or email.
The refund is due within 14 days, respectively:
- for Products that have not been delivered to the shipping address provided by you within 30 days from the conclusion of the Contract, with effect from the sending of a confirmation email that your order has been cancelled; or
- for Products that have been delivered, with effect from the receipt of the Products returned by you or, if earlier, from the date when proof is provided that you have returned the Products.
During the Cooling Off Period, you are entitled to a refund of the full price of the Products (subject to any deductions due as a result of the use or damage of the Product), as well as the standard shipping costs. However, as stated above, the cost of the return of the Products will not be refunded.
If the payment for the Products has been made by card, the refund will be made by crediting the amount to the account of the payment card that was originally debited.
Once the Cooling Off Period as indicated above has expired, you will not be entitled to any refund if you decide to return the Product.
Unless otherwise agreed between the Parties, the customer cannot exercise the right of cancellation, inter alia, in the following cases:
- Jona products made with a specific customisation for the Customer;
- products which by their nature cannot be returned or risk being damaged;
- in all other cases provided by law, with particular reference to Annex 59 of the Italian Consumer Code
In any event, the right of cancellation will not apply if the product has been used or handled in a manner other than that strictly necessary to establish its features and functioning.
