The following information is provided pursuant to Article 49 of the Italian Consumer Code (Italian Legislative Decree 206/2005 or "Italian Consumer Code").

These Conditions of Sale apply to the Website www.jona.it (the “Website”, “our Website”).
To buy our products you must have reached legal age as established by the law of your country of residence.
Orders are made through the Jona Website in the manner described below:
- When you are ready to make a purchase, click on the ‘add to Shopping Bag’ button to place the Product you want to buy into your Shopping Bag. Then continue by clicking ‘purchase it’ to access our secure server to complete your Order.
- If it is your first purchase on the Jona Website, after you have completed the payment, you can choose to create an account with us using your email address, in which case you will be asked to create a password. The password must be kept secret and must not be disclosed or shared with anyone else. Your password will be stored in a secure system that will allow you to recover it in case of loss when making future purchases. Accordingly, you will be asked to provide your email address. The email address you use for the registration process must be the same as the email address that your order confirmation will be sent to.
- If you are already registered at the Jona Website, you can enter your login credentials to access your account.
- Please indicate your preferred delivery address (if there are shipping charges, they will be applied to the total amount and you will be able to verify the amount before sending the Order), confirm your address and enter your payment details. You can check and correct any errors in your order before sending it by clicking on the ‘Complete Purchase and Pay’ button.
- We recommend that you make sure that your order is correct before sending it. You will be responsible for the correctness of the Order you send to us. If you have any problems with your order or you have doubts of any kind, we will be happy to help and you can contact us by telephone at the number +39 0118123967, or by email at the address firstname.lastname@example.org. We will answer you and provide assistance as quickly as possible.
- You will then be sent a confirmation email (Order Confirmation) to verify the receipt of your Order. The message will be automatically sent to the email address you used for your registration. This Order Confirmation does not mean that your Order has been accepted. Your Order is merely a contractual offer for the purchase of the Jona Product(s) at the price stated in the Order.
- All Orders are subject to our prior acceptance. We reserve the right to decline any Order at our discretion and we are not obliged to accept them. However, we remind you that, by clicking on the ‘Complete Purchase and Pay’ button, you assume the obligation to pay the price of the Product(s) if your order is accepted.
- After the confirmation email has been sent (“Order Confirmation”), we will verify whether we are able to execute your order. We will process the payment information provided by you to credit the payment for your Order.
The acceptance of your Order will be conditional upon payment being made and the confirmation by us in a second email (“Acceptance Email”) of the execution of your Order and shipment of the Product(s) to the delivery address provided by you. The message will be automatically sent to the email address you provided upon registration.
- You will receive an additional email notification as soon as we have delivered your package to the courier.
These General Conditions of Sale may be changed by Jona at any time. The version of the General Conditions of Sale in force at the time of conclusion of the contract of sale shall apply between Jona and the User.
The conclusion of the online contract of sale takes place upon payment for the Jona products based on the payment method chosen by the User from those available on our Website.
The online contract of sale for the products purchased on the Website is considered concluded when Jona receives payment from the User of the price set for those products as listed on the Website at the time of purchase.
Jona is not bound to Conditions of Sale other than these conditions, and has the right, without notice, to change the Jona products offered for sale on the Website, as well as their images and their characteristics.
The acceptance of these Conditions of Use by the User is essential for completion of the purchase of the Jona products.
Once the Contract has been concluded, Jona shall have the obligation to deliver the Products in accordance with the terms of the Contract.
- The Contract refers solely to the Product(s) whose dispatch has been confirmed through the sending of the Dispatch Email. We will not be required to supply additional Products included in any other order from you until the dispatch of those additional Products has been confirmed in a separate Dispatch Email.
- For added safety, please check the Confirmation Email and the Acceptance Email and immediately notify us if there are any errors.
- If there are any problems with your Order, you will be promptly contacted by us.
The validity of the contract of sale is subject to product availability. We undertake to report any non-availability of a product in the Website’s product list. However, we do not guarantee that the availability of the Jona products on the Website will be updated on a daily basis. If you purchase a product on our Website that turns out to be unavailable, we undertake to notify you within – at the most – 5 working days from the receipt of your order and we undertake to refund the full price paid including the amount paid by you for shipping (with no additional charge or fee of any kind to be borne by Jona).
The order contains all the essential elements of a contract of sale including the information required by law. Please check the purchase order in advance before you send it and check that the resulting confirmation email contains the correct information and matches the order made.
Once payment has been received, we will immediately prepare your product and dispatch it. For Products that are already available we usually need 2 working days to complete these preparations. For Products for which an ordinary modification has been requested (e.g., adjusting a ring size, bespoke engraving , lengthening a bracelet or a necklace) the time needed is a maximum of around 5 working days. For Products ordered with a special customisation, the times will vary depending on the type of work involved.
The products purchased will only be delivered after the payment has been made by you.
Shipping times vary from country to country and will be indicated in the order confirmation email sent by Jona to the Customer to the email address provided upon registration on the Website.
Jona has been shipping and delivering its products for a number of years using the DHL courier service in all countries within and outside the European Union.
Delivery times vary depending on the destination country:
Italy & Europe: 1-2 working days
USA & Canada: 3-4 working days
Rest of the World: 4-5 working days
Shipping is free for orders over €200.00 (or the equivalent in US$ at current exchange rates) to be delivered to the same delivery address.
Under this amount, the shipping charges are not included in the prices listed on the Website, and are set at the following amounts:
€9.00 for Italy
€18.00 for Europe
€28.00 for USA and Canada (or the equivalent in US$ at current exchange rates)
€40.00 for the rest of the world (or the equivalent in US$ at current exchange rates)
These costs will be stated in the order confirmation email, together with the delivery times.
In the event of unjustified refusal to accept delivery of the product, Jona will have the right to terminate the contract of sale, without prejudice to compensation for damage, including any costs of storage of the products.
Prices and shipping costs may be subject to change at any time, without affecting orders already confirmed by the sending of the Acceptance Email.
The prices are checked regularly, however, if we notice a change or a mistake in the price upon receipt of your order, we will contact you to confirm whether you still wish to continue with the purchase at the correct price. If you provide confirmation to that effect, please remember, however, that this does not result in any obligation for us to supply the Product(s) until the Acceptance Email confirming the Order has been sent.
For orders to European Union countries, the prices of the products stated on our Website include VAT of 22% due on the purchase of the Products.
For orders to countries outside the European Union, the prices of the Jona products stated on the Website do not include VAT and the related import duties, and these will be entirely at your expense. Jona may choose, at its discretion, to totally or partially refund the import duties, upon written agreement by email.
All payments must have already been made at the time of delivery of the Product(s). The payment for the Product(s) must be made by credit or debit card or by bank transfer. We accept payments by Visa, MasterCard, American Express, Maestro, PayPal or by bank transfer. If we are unable to accept your order for any reason, we reserve the right to choose whether to reject your debit or credit card or to refund the sums paid in relation to your order. No shipment of the Product(s) will be made until payment has been received in full. Please note that a fee may be applied to the payment for online transactions, if provided for by your card issuer. This fee is not attributable to us.
With regard to card payments, the holders of credit and debit cards may be subject to authorisation and authentication. We shall not be liable for any delay or non-delivery of the Product(s) ordered by you if your card issuer or our service provider refuses or does not authorise or validate the payment for any reason.
In providing your information details you expressly consent to their disclosure to third parties; to the subsequent access to additional information by third parties, including, depending on the case, your name, address, phone number, details of credit or debit cards or bank accounts; to the authentication of your identity and of the delivery address for the Products(s); and to the confirmation of your payment card and the obtaining of the authorisations required to make the payment for the Product(s).
The Product(s) will be delivered to the address provided by you in the Order within the times communicated in our Acceptance Email, but we cannot guarantee an exact delivery date.
If the Product(s) is (are) not delivered within 40 days from the Contract or such other date as may be agreed, you will have the right to terminate the Contract and any amount paid by you will be refunded without further delay.
The ownership and risks related to the Product(s) will be transferred to you upon delivery.
Upon delivery, you must carefully check the Product(s) to verify whether there are any defects or damage. If you find any defects or damage, you must report themto us by email to email@example.com no later than 8 days from the day you received the Product. If it is established that the damage to the Product(s) took place before delivery, or the defect was not due to your actions or use, we will arrange for the repair or replacement of the Product(s) or a full refund of the price you paid, including any shipping costs, on condition that the damage did not result from the Product(s) having been worn or used. If you prefer to have the Product(s) repaired or replaced, please contact us and we will replace the item without further charge where possible. In addition, we will refund the expenses incurred for returning the item or we will send our courier to collect the damaged or defective item.
In the event of lack of conformity of the Products pursuant to Article 129 of the Italian Consumer Code, the legal guarantees established in Articles 129 and following of the Italian Consumer Code shall apply. You are entitled to the restoration, without charge, of the conformity of the goods by repair or replacement. If the above remedies cannot be implemented, you have the right to an appropriate reduction of the price of the products, or to terminate the contract. These rights are considered waived if the potential lack of conformity is not notified within two months of the date when it was discovered. Our liability extends to the discovery of any lack of conformity within two years from delivery of the products. In any event, the right to bring an action to establish any lack of conformity, if not wilfully concealed by us, automatically ceases after twenty-six months from delivery.
Despite all the efforts made to present the Product(s) on the Website in the clearest and most realistic manner possible through the use of high-quality photographic equipment, some items may appear slightly larger or smaller than their actual size due to defects in the screen or the photographic techniques used. Other items may be represented on a larger scale compared to their actual size in order to highlight all their details, or on a smaller scale to show the object as a whole. In addition, the details shown on the screen (such as colours, patterns, textures, etc.) depend on the characteristics of the device used, and may therefore not accurately reflect the actual properties of the Products that will be delivered.
These Conditions of Sale and any other document expressly referred to within them represent the entire agreement between the Parties with reference to the object of the Contract. The Contract and any further communication between the Parties will be written in Italian or English.
The format, existence, construction, implementation, validity and all other aspects of these Conditions of Sale or any of the clauses contained therein are governed by Italian law.
Any disputes concerning the interpretation, validity or implementation of these Conditions of Sale shall be referred to the exclusive jurisdiction of the competent court in the place of residence or domicile of the consumer.
You may request the use of an out-of-court mechanism to settle disputes arising from the Contract at the relevant bodies set up by the Chambers of Commerce in accordance with the Italian Law 580 of 29 December 1993, and you may also use the mediation procedure pursuant to Italian Legislative Decree 28/2010, as amended, in accordance with the applicable provisions of the organisation chosen by you. You will also still have the right to use the voluntary negotiation procedures provided for in Article 2, paragraph II of the aforementioned Italian Legislative Decree, as well as the complaints procedures provided for by the service charters.
The establishment by the courts of the invalidity or unenforceability of one or more provisions of these Conditions of Sale shall not affect the validity and enforceability of any remaining provisions.
No delay or failure to exercise powers, rights or remedies granted under these Conditions of Sale shall be considered as a waiver thereof, nor shall the partial exercise of any such powers, rights or remedies prevent their further exercise in the future. Governing law and jurisdiction
These General Conditions of Sale and the related Contract of Sale entered into by you and Jona and the Customer are governed by Italian law and in particular by Italian Legislative Decree 70/2003 on electronic commerce, and, for end customers only, by Article 1 of Italian Legislative Decree 206/2005 (Italian Consumer Code), subject to any applicable mandatory rules of law of the country of residence of the customer.
Any communications to us must be made in writing to the address stated at the beginning of these Conditions of Sale. Any communications to you may be made either to the email address or the postal address provided by you when sending the Order.
The contract of sale and the related documents relating to orders shall be stored, preserved and archived on our premises, for all the requirements necessary for the performance of the contract, as well as the related obligations and the requirements of law, in compliance with the Italian Personal Data Protection Code (Italian Legislative Decree 196/2003).
You can ask to access and view the documents relating to you by written request to be sent by email. We undertake to provide you a copy of those documents within 7 working days of receipt of your request.
In any event, we ask you to store and keep an electronic and paper copy of your contract of sale.
